{"id":418516,"date":"2023-12-01T14:21:45","date_gmt":"2023-12-01T19:21:45","guid":{"rendered":"https:\/\/www.housingwire.com\/?p=418516"},"modified":"2023-12-01T14:21:49","modified_gmt":"2023-12-01T19:21:49","slug":"hud-proposes-30-day-notice-rule-for-public-housing-rent-nonpayment","status":"publish","type":"post","link":"https:\/\/www.housingwire.com\/articles\/hud-proposes-30-day-notice-rule-for-public-housing-rent-nonpayment\/","title":{"rendered":"HUD proposes 30-day notice rule for public housing rent nonpayment"},"content":{"rendered":"\n<p>The <a href=\"https:\/\/www.housingwire.com\/tag\/hud\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>U.S. Department of Housing and Urban Development<\/strong><\/a> (HUD) on Friday published a proposal that would require public housing agencies (PHA) to provide 30 days&#8217; notice before filing an eviction notice in court for nonpayment of <a href=\"https:\/\/www.housingwire.com\/tag\/renters\/\" target=\"_blank\" rel=\"noreferrer noopener\">rent<\/a>.<\/p>\n\n\n\n<p>PHAs with tenants in <a href=\"https:\/\/www.housingwire.com\/tag\/public-housing\/\" target=\"_blank\" rel=\"noreferrer noopener\">public housing<\/a> and owners of properties participating in HUD multifamily project-based <a href=\"https:\/\/www.housingwire.com\/tag\/rental-assistance\/\" target=\"_blank\" rel=\"noreferrer noopener\">rental assistance<\/a> programs would need to provide \u201cwritten notification at least 30 days\u201d before a court filing for an eviction due to rent nonpayment.<\/p>\n\n\n\n<p>The proposal, published in the <a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/12\/01\/2023-26348\/30-day-notification-requirement-prior-to-termination-of-lease-for-nonpayment-of-rent\" target=\"_blank\" rel=\"noreferrer noopener\">Federal Register<\/a>, also requires that the 30-day notice \u201cinclude instructions on how tenants can cure lease violations for nonpayment of rent and information on how to recertify their income and request a minimum rent hardship exemption if applicable to avoid eviction,\u201d HUD said in its proposal announcement.<\/p>\n\n\n\n<p>\u201cHUD-assisted rental housing allows millions of people to achieve stability for themselves and their families,\u201d said Solomon Greene, HUD&#8217;s Principal Deputy Assistant Secretary (PDAS) for Policy Development and Research. \u201cThis proposed rule would give many HUD-assisted renters an opportunity to catch up if they fall behind on rent and avoid the harmful consequences of evictions, while also preventing landlords and PHAs from encountering costly unit vacancies.\u201d<\/p>\n\n\n\n<p>Another reason for the proposed rule is that the <a href=\"https:\/\/www.housingwire.com\/tag\/evictions\/\" target=\"_blank\" rel=\"noreferrer noopener\">eviction<\/a> process is both costly and time-consuming, according to Richard Monocchio, PDAS for Public and Indian Housing.<\/p>\n\n\n\n<p>\u201cWe are very proud of this proposed rule, and we welcome feedback from all interested stakeholders to make it even more practical and effective,\u201d Monocchio said.<\/p>\n\n\n\n<p>HUD estimates that the proposal would affect 3.9 million people in 2.2 million households, including 1.7 million people in 840,000 households in public housing and 2.2 million people in 1.4 million households in project-based rental assistance (PBRA) programs.<\/p>\n\n\n\n<p>Stakeholders may offer comments on the proposal until Jan. 30, 2024.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The proposal would give residents of public housing more time to cure lease violations and avoid eviction, HUD said in an announcement.<\/p>\n","protected":false},"author":7007,"featured_media":335122,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[2020,268078],"tags":[3560,36662,5806],"coauthors":[239905],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v21.5 (Yoast SEO v21.7) -
